A submitted application is only a request. A rental is not approved or secured until Banks A&M Rentals LLC accepts the request and confirms receipt of the required deposit. Pickups are at 10:30 AM. The renter must return the vehicle on the confirmed return date and time unless Banks A&M approves an extension in writing.

The renter must pay the confirmed rental charge and all applicable taxes and fees. Every regular rental requires a $50 deposit, and that entire $50 deposit is always nonrefundable. Approved out-of-state travel adds another $25 nonrefundable deposit, making the total out-of-state deposit $75. The entire $75 out-of-state deposit is always nonrefundable.

The renter must be at least 23 years of age and have a valid, unexpired driver’s license. The renter may not allow any person who is not expressly approved by Banks A&M Rentals to operate the vehicle. The renter states that required financial responsibility is provided through the renter’s motor vehicle liability policy and must provide proof showing liability, comprehensive and collision coverage and the applicable deductibles. Coverage is subject to verification and insurer terms.

Unlimited mileage applies only while the vehicle remains in Pennsylvania. The vehicle may not leave Pennsylvania without prior written approval. Approved out-of-state travel adds a separate $100 fee to the regular rental charge and another $25 to the nonrefundable deposit, making the total out-of-state deposit $75. The entire $75 deposit is always nonrefundable. The renter is responsible for every toll, violation, penalty and related administrative charge and, to the extent permitted by law, for returning or towing the vehicle back to Pennsylvania.

The renter is fully responsible for arranging and paying to have the vehicle towed when required, except to the extent prohibited by law or caused by a condition for which Banks A&M Rentals is legally responsible. The renter must contact Banks A&M before authorizing repairs and must not abandon the vehicle.

Late returns are charged at $5 per hour. After five hours late, the applicable full daily rate is charged. A $250 recovery fee applies when Banks A&M Rentals must retrieve the vehicle, in addition to lawful towing, storage, toll, damage and other charges. Keeping the vehicle longer requires written approval and payment before the existing term ends.

The vehicle must be returned with at least one-quarter tank of fuel, reasonably clean, with all keys and equipment, and in the condition documented at pickup except ordinary wear. The renter is responsible for disclosed cleaning, refueling, lost-key, lockout and replacement costs to the extent caused during the rental.

The renter must protect the vehicle, stop after any accident, contact police when required, promptly notify Banks A&M Rentals and the applicable insurer, exchange required information, photograph the scene when safe, and cooperate with all claims. The renter is responsible for loss or damage to the extent allowed by Pennsylvania law and the applicable insurance policy. Nothing in this agreement waives rights or duties that cannot lawfully be waived.

The renter understands that the vehicle may contain GPS or telematics equipment used for location, theft prevention, recovery, maintenance and enforcement of the rental terms. The renter may not disable, remove or interfere with that equipment.

Material false information, unauthorized use, failure to pay, failure to return the vehicle, loss of required insurance, illegal use, abandonment or a serious breach may end the rental. Banks A&M Rentals may recover the vehicle by lawful means and charge amounts permitted by the agreement and law.

Pennsylvania law governs this agreement. The renter agrees to conduct this transaction electronically, use an electronic signature, and receive a retainable electronic copy. Electronic consent is voluntary; the renter may ask Banks A&M Rentals for a paper signing process before signing. If any term is unenforceable, the remaining lawful terms remain in effect.
